Could you go to jail for a DWI?

You just got pulled over for a DWI. You’re worried. The first thought is, this is the first time you’ve ever had any sort of contact with law enforcement and are you going to go to jail? Well, each county is a little different. Each county handles things a little differently in Southwest Missouri. Any attorney who walks into the room, sits down and says “We’re keeping you out of jail,” well, they’re lying to you because they don’t know the facts yet.

It all comes down to the details.

You have to look into each individual case and consider the who the prosecutor is, consider who the judge is, consider the jurisdiction and what they typically do and analyze the case. Now the short answer is, based on my experience, the vast majority of time, jail is not an issue right upfront. But, each case is individual so we have to look at each one individually. If there is some sort of jail sentence, that is something we will prepare you for months in advance.
